1. Information We Collect

To provide high-performance marketing and scalable business solutions, we collect information across three distinct categories:

• Directly Provided Information: Full name, WhatsApp phone number, email address, company/brand name, project specifications, and inquiry messages submitted via our landing pages, contact forms, or direct messaging channels.
• Automated Technical & Device Data: IP addresses, browser type, device identifiers, operating system version, referring URLs, access timestamps, and approximate geolocation derived through standard server logs.
• Advertising & Performance Analytics: Click-through actions, interaction events, conversion checkpoints, and lead status metrics captured during active campaign funnels to monitor ad efficiency.

2. How We Use Your Data Across Multiple Businesses

We process your data strictly for legitimate commercial operations and high-converting marketing fulfillment, including:

• Designing, deploying, and optimizing custom landing pages tailored for Google Ads and Meta Ads campaigns.
• Connecting you seamlessly with our 24/7 client support desks via official WhatsApp and Telegram channels.
• Auditing, tracking, and scaling multi-channel paid ad campaigns to improve Return on Ad Spend (ROAS).
• Facilitating verified community onboarding, member support, and technical automation workflows.
• Monitoring traffic quality, mitigating invalid ad clicks, and protecting our advertising networks.
• Delivering project milestones, critical security updates, and relevant business scaling opportunities.

3. Multi-Brand & Client Data Segregation

As an agency and ecosystem supporting multiple business verticals, e-commerce stores, and community channels, we maintain strict cross-brand data confidentiality. We never pool, cross-target, or disclose proprietary customer data, lead lists, or campaign metrics between independent clients or competing ventures. Each client's data remains strictly segregated and protected.

4. Cookies, Tracking Pixels & Marketing Tags

We implement industry-standard tracking technologies to gauge marketing engagement and optimize campaign delivery:

• Essential & Performance Cookies: Necessary for smooth navigation, fast loading times, and responsive rendering across mobile and desktop devices.
• Meta Pixel & Conversions API: Used to track conversion actions originating from Facebook and Instagram ads, preventing ad fatigue and refining audience targeting.
• Google Analytics & Tag Manager: Analyzes user behavior, bounce rates, and navigation pathways to enhance landing page speed and user experience.

You can configure your browser to reject cookies or notify you when cookies are sent. Disabling cookies will not prevent you from contacting our team or using our services.

5. Data Sharing & Third-Party Service Providers

We respect your trust. We do not sell, rent, monetize, or trade your personal information with third parties. Data is shared only under strict operational conditions:

• Authorized Infrastructure Partners: Cloud hosting providers, secure data repositories, and communication APIs (WhatsApp Business Platform, Telegram API).
• Advertising Networks: Aggregated, hashed event telemetry shared with Meta and Google in compliance with their developer security protocols.
• Legal & Regulatory Compliance: Where required by law, court order, or governmental authorities to protect legal rights, property, and user safety.

6. Data Security & Encryption

We employ multi-layered security measures, including 256-bit SSL/TLS encryption for all data in transit, firewall architecture, restricted role-based administrative access, and proactive threat monitoring. While no digital system can guarantee 100% immunity, we adhere to recognized commercial standards to protect all stored information.

7. Data Retention & Your Privacy Rights

We retain your contact records only as long as necessary to fulfill active business projects, maintain accounting records, and satisfy legal obligations. Depending on your jurisdiction, you have the right to:

• Request confirmation and access to personal data held about you.
• Request immediate correction of inaccurate or outdated contact details.
• Request permanent deletion of your contact records ("Right to Erasure"), subject to statutory record-keeping requirements.
• Opt-out of promotional communications at any time by messaging our desk.

8. Third-Party Platform Disclaimers

9. Policy Modifications & Contact

We may update this Privacy Policy periodically to accommodate new multi-business capabilities, regulatory updates, or ad platform terms. Revised policies become effective upon posting.

For privacy inquiries, data deletion requests, or compliance questions, please contact our administrative desk at support@bigxfoodhouses.shop.

3. Client Responsibilities & Ad Policy Compliance

To ensure high standards and ad network compliance across all business ventures, clients agree to the following:

• You are solely responsible for ensuring your advertised products, services, offers, and business practices comply with all local, national, and international laws.
• All materials, logos, images, and content provided to Big X Food House must be legally owned by you or appropriately licensed without infringing on any third-party intellectual property.
• You must strictly adhere to the advertising policies of Meta Platforms Inc. and Google LLC. We do not service deceptive, fraudulent, illegal, or prohibited business categories.
• Big X Food House reserves the absolute right to refuse or immediately terminate services for any campaign that violates advertising standards or ethical business practices.

4. Performance Disclaimers & Realistic Expectations

5. Third-Party Ad Networks & Platform Autonomy

Big X Food House operates as an independent technical and creative consulting agency. As such:

• Meta, Google, WhatsApp, and Telegram operate autonomously under their respective terms and algorithms.
• Ad account verifications, billing reviews, ad approvals, and algorithmic traffic distribution are solely determined by the respective platforms.
• Big X Food House is not liable for account suspensions, review delays, algorithm updates, or policy enforcement actions enacted by third-party ad networks.

6. Fees, Milestone Payments & Refund Policy

We adhere to transparent commercial billing terms:

• Service Retainers vs. Advertising Spend: Fees paid to Big X Food House cover custom design, engineering, copywriting, setup, and consulting labor. Advertising budgets (ad spend) are billed directly by Meta or Google to the client's own payment methods.
• Payment Milestones: Development projects require agreed advance retainers or milestone payments prior to live server deployment or source code handover.
• Non-Refundable Policy on Digital Labor: Because landing page development, creative assets, and marketing configurations represent immediate custom labor and proprietary digital intellectual property, all fees paid for completed milestones, live landing pages, and advisory hours are strictly non-refundable once work has commenced.

7. Intellectual Property & Usage Licenses

Intellectual property rights are structured fairly:

• Client Property: You retain complete ownership of your pre-existing trademarks, trade names, customer databases, and proprietary brand materials.
• Delivered Landing Pages: Upon full settlement of all project invoices, you receive a perpetual, non-exclusive license to use the delivered landing page assets for your commercial operations.
• Proprietary Agency Frameworks: Big X Food House retains all rights and title to our underlying design systems, code libraries, automation scripts, and proprietary campaign structures.
• Portfolio Display: Big X Food House reserves the right to showcase non-confidential landing page designs, creatives, and anonymized growth metrics within our agency portfolio.

8. Limitation of Liability & Indemnification

To the fullest extent permitted by applicable law, Big X Food House, its founders, team members, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages (including lost profits, loss of business reputation, or data interruptions) arising out of or related to our services or website.

You agree to indemnify, defend, and hold harmless Big X Food House against any third-party claims, liabilities, damages, and legal costs arising from your business products, customer fulfillment, or violations of these Terms.

9. Termination & Service Suspension

Either party may terminate ongoing retainer or advisory arrangements upon written notice as stipulated in individual service agreements. Big X Food House reserves the right to immediately suspend or revoke managed hosting or technical support in the event of non-payment, chargebacks, abusive behavior, or verified fraudulent activity.

10. Governing Law & Official Support

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any legal dispute arising out of or relating to these Terms shall be resolved through good-faith negotiation, and if necessary, submitted to the competent courts of jurisdiction.

For questions, formal notices, or contract inquiries regarding these Terms, contact our official Big X Food House administrative desk at support@bigxfoodhouses.shop.
